ESSENSE OF AUSTRALIA, TRUE SOCIETY IN-STORE “MAGIC OF THE SEASON GIVEAWAY” 

GIVEAWAY OFFICIAL RULES FOR SWISS RESIDENTS (“Official Rules – Switzerland”) 

The organizing company and sponsor for the Giveaway is Essense of Australia, Inc., 15500 W. 113^th Street #300 Lenexa, KS 66219, United States of America (“Sponsor”). 

The Giveaway is taking place at True Society – Zug, Bahnhofstrasse 13, 6300 Zug, Switzerland (“Participating Store”). 

By participating in the Giveaway, the participant agrees with the following terms and terms and conditions: 

ELIGIBILITY: 
The Magic of the Season Giveaway (“Giveaway”) is open to legal residents of Switzerland, who are at least eighteen (18) years of age as of the date of participation. Employees of the Sponsor, True Brides AG, and their respective parent companies, subsidiaries, divisions, affiliates, suppliers, distributors, and advertising, promotional and the immediate family members (spouses, parents, children and siblings and their spouses) and household members of each (whether related or not), are not eligible to participate or win.  

GIVEAWAY PERIOD: 

The Giveaway will occur at the Participating Store during regular business hours, between Tuesday, November 22, 2022, at 8:00 AM to 11:59PM on Friday, December 23, 2022, in the applicable time zone of the Participating Store (the “Giveaway Period”). The Participating Store’s clock is the official timekeeping device for this Giveaway. 

PARTICIPATION: 

During the Giveaway Period, participants have to visit the Participating Store and locate the available gift certificates. Indicate to the store representative which one you would like. Each stocking contains a certificate with one of the prizes listed on it.  Participants are subject to all notices posted in-store. Limit: There is a limit of one (1) gift per customer. 

Participation is free of charge. Participants only have to visit the Participating Store and select the gift certificate. There is no purchase or payment of any kind necessary to participate in the Giveaway. A purchase does not improve the chance of winning. There is no legal entitlement for participation or access to the Giveaway and legal action for participation is excluded. 

PRIZES: 
The prize/s is/are described below: 

There are six (6) different Prizes available to be won per Participating Store. Each Prize winner will receive one of the prizes listed below in the form of a Gift Certificate. Gift Certificates are valid only on new Wedding dress orders or purchases made during the Sweepstakes Period and must be redeemed by December 31, 2022. Gift certificates can only be redeemed at the same True Society store the gift certificate was received. The maximum ARV (Approximate Retail Value) of each prize is listed below.  

Prizes will be awarded only if the potential prize winner fully complies with these Official Rules. All portions of the prize are non-assignable and non-transferable. Prizes pictured in point-of-sale, online, television and print advertising, promotional packaging, and other Giveaway materials are for illustrative purposes only. All details and other restrictions of the prize not specified in these Official Rules will be determined by Sponsor in its sole discretion. No cash alternative or substitution of the prize will be allowed, except Sponsor reserves the right in its sole discretion to substitute prize of comparable value if any prize listed is unavailable, in whole or in part, for any reason.  

TAXES: 

Prizes are generally not subject to Swiss income tax, but the Swiss cantons might impose a gift tax provided that the recipient of the prize is resident there. Although prizes are not subject to Swiss income tax, they are generally to be reported in the individual tax returns.   

DISQUALIFICATION: 
Any violation of these Official Rules by winner will result in winner’s disqualification as winner of the Giveaway, and all privileges as winner will be immediately terminated. 

TERMINATION OF THE GIVEAWAY: 

Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, extend, or suspend this Giveaway for any material reason, in particular if a secure, fair, and proper conduct of the Sweepstake is affected. Sponsor does not assume liability for lost chances of winning. 

LIMITATION OF LIABILITY: 

The Sponsor, its subsidiaries and affiliates are not liable for are not responsible for: (i) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of materials. Sponsor is only liable in case of intent or gross negligence. For any damages resulting from injury to life, body, or health the Sponsor is also liable for ordinary negligence.  

GOVERNING LAW: 

These Official Rules – Switzerland shall be governed by laws of Switzerland. 

MISCELLANEOUS: 

The invalidity or unenforceability of any provision of these Official Rules – Switzerland shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules – Switzerland shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. These Official Rules – Switzerland can be amended any time by the Sponsor without notification, provided that such amendments are necessary in order to assure proper and safe conduct of the Giveaway, and to prevent misuse or fraud in particular.
