SWEEPSTAKES OFFICIAL RULES FOR EU RESIDENTS (“Official Rules”) – Germany
The organizing company and sponsor for the Sweepstakes is Fashion Department Berlin GmbH, Gertraudenstrasse 10, 10178 Berlin (“Sponsor”).
The Sweepstakes are taking place at True Society – Berlin, Located Inside Hochzeitshaus, Gertraudenstrasse 10, 10178 Berlin Mitte (“Participating Store”).
Information on the processing of your personal data can be found in our privacy policy that will be provided to you in a separate document handed to you together with these Official Rules.
By participating in the Sweepstakes, the entrant agrees with the following terms and terms and conditions:
ELIGIBILITY:
This sweepstakes (“Sweepstakes”) is open to legal residents of Germany, who are at least eighteen (18) years of age as of the date of entry. Employees of the Sponsor, and their respective parent companies, subsidiaries, divisions, affiliates, suppliers, distributors, and the immediate family members (spouses, parents, children and siblings and their spouses) and household members of each (whether related or not), are not eligible to participate or win. No photocopied entries, automated entry devices and/or programs permitted.
SWEEPSTAKES PERIOD:
The Sweepstakes will occur at the Participating Store during regular business hours, between Tuesday, November 23, 2021, Saturday, November 27, 2021, in the applicable time zone of the Participating Store (the “Sweepstakes Period”). The Participating Store’s clock is the official timekeeping device for this sweepstakes.
PARTICIPATION:
During the Sweepstakes Period, participants have to visit the Participating Store, locate the available forms for participation provided in the Participating Store (“Official Entry Forms”), follow all instructions to complete the Official Entry Form and place it in the entry box provided to receive one (1) Sweepstakes Entry (the “Entry”). Each Entry will be automatically entered into a random drawing to win one (1) of the prizes listed below. Sponsor is not responsible for lost, late, misdirected, damaged, incomplete, altered, or illegible entries. All Entries become the property of the Sponsor and will not be acknowledged or returned. Entrants are subject to all notices posted in-store. Limit: There is a limit of one (1) entry per person.
Participation is free of charge. Participants only have to visit the Participating Store and fill out the Official Entry Form. There is no purchase or payment of any kind necessary to participate in the Sweepstakes. A purchase does not improve the chance of winning. There is no legal entitlement for participation or access to the Sweepstakes and legal action for participation is excluded.
Participants need a valid email to enter into the Sweepstakes. In case of dispute as to the identity of any entrant, entry will be declared made by the authorized account holder of the email address account submitted at time of entry. “Authorized Account Holder” is defined as the natural person who is assigned an email address by an Internet access provider, online service provider, or other organization (e.g., business, educational, institution, etc.) responsible for assigning email addresses or the domain associated with the submitted email address. Any potential winner may be requested to provide Sponsor with proof that such winner is the authorized account holder of the email address associated with the winning entry.
Sponsor is not responsible for lost, late, illegible, stolen, incomplete, invalid, unintelligible, misdirected, technically corrupted or garbled entries, which will be disqualified, or for problems of any kind whether mechanical, human, or electronic. Only fully completed entry forms are eligible. Proof of submission will not be deemed to be proof of receipt by Sponsor.
WINNER SELECTION:
Winners will be selected by a representative of the Sponsor whose decisions are final. The potential Prize winner will be selected in a random drawing from among all eligible entries received at the Participating Store during the Sweepstakes Period. The Random Drawing will occur on or about 10:00 AM on Tuesday, November 30, 2021. The potential prize winner will be notified via phone and/or email by a store manager. All prize winners are required to redeem the prize by June 1st, 2022. Noncompliance will result in disqualification. Odds of winning depend on the number of eligible entries received for the drawing.
PRIZES:
The prize/s is/are described below:
There are three (3) different prizes available to be won per Participating Store. Each prize winner will receive one of the prizes listed below in the form of a gift certificate (“Gift Certificate”). Gift Certificates must be redeemed by June 01, 2022 and can only be redeemed at the same Participating Store the entry was received. The maximum ARV (Approximate Retail Value) of each prize is listed below.
1. 1 – Free Bridal Dress (€6250.00) – no custom dresses, no specials or modifications, dress only
2. 3 – 1 Free Veil from a choice of 3 Styles: AVL 0060 Ivory Fingertip or Cathedral, AVL0041 Ivory Fingertip or AVL0042 Ivory Cathedral (€550.00)
3. 1 – Gift Certificate for 20% off Bridal Dress (€615.00)
Prizes will be awarded only if the potential prize winner fully complies with these Official Rules. All portions of the prize are non-assignable and non-transferable. Prizes pictured in point-of-sale, online, television and print advertising, promotional packaging, and other Sweepstakes materials are for illustrative purposes only. All details and other restrictions of the prize not specified in these Official Rules will be determined by Sponsor in its sole discretion. No cash alternative or substitution of the prize will be allowed, except Sponsor reserves the right in its sole discretion to substitute prize of comparable value if any prize listed is unavailable, in whole or in part, for any reason. All potential taxes are the sole responsibility of the winners.
NOTIFICATION:
Winners will be notified via phone and/or email from an official Sponsor representative on or about Tuesday, November 30, 2021. If any winner cannot be contacted within seven (7) business days of first notification attempt or does not reply within this period, if any prize or prize notification is returned as undeliverable, if any winner rejects his/her prize or in the event of noncompliance with these Official Rules and requirements, such prize will be forfeited, and an alternate winner will be selected from all remaining eligible entries. Upon prize forfeiture, no compensation will be given. Limit one prize per person.
DISQUALIFICATION:
Any violation of these Official Rules by winner will result in winner’s disqualification as winner of the Sweepstakes, and all privileges as winner will be immediately terminated.
TERMINATION OF THE SWEEPSTAKES:
Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, extend, or suspend this Sweepstakes for any material reason, in particular if a secure, fair, and proper conduct of the Sweepstake is affected. In such case, Sponsor will select the winner(s) from all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor. Sponsor does not assume liability for lost chances of winning.
LIMITATION OF LIABILITY:
The Sponsor, its subsidiaries and affiliates are not liable for are not responsible for: (i) lost, late, misdirected, damaged or illegible entries; or (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof; or (iii) any injury or damage to entrant’s or any other person’s computer related to or resulting from participating in the Sweepstakes. Sponsor is only liable in case of intent or gross negligence. For any damages resulting from injury to life, body, or health the Sponsor is also liable for ordinary negligence. Above that the Sponsor is liable for any culpable breach of the essential contractual obligations. Essential contractual obligations are those obligations necessary to conduct the contract and whose adherence the entrants can reasonably rely. This clause does not affect responsibility under product liability legislation.
GOVERNING LAW:
These Official Rules shall be governed by laws of Germany.
MISCELLANEOUS:
The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. These rules can be amended any time by the Sponsor without notification, provided that such amendments are necessary in order to assure proper and safe conduct of the Sweepstakes, and to prevent misuse or fraud in particular.
DATA PROTECTION INFORMATION NOTICE
1. Fashion Department Berlin GmbH, Gertraudenstrasse 10, 10178 Berlin, (“Participating Store”, “We”, “Us”) is responsible for the processing of personal data as controller within the meaning of the General Data Protection Regulation (GDPR) in connection with the sweepstakes you decided to participate in and as outlined in the Sweepstakes Official Rules for EU Citizens – Germany (“Sweepstakes”).
2. Data Categories and Processing Purpose: The processing of your personal data (namely phone number, email address, first name, last name, postal address) is carried out for the purpose of handling the Sweepstake. The personal data is used to (i) identify the entrants, (ii) draw the winner of the Sweepstakes, (iii) to notify them of winnings and (iv) to process any winnings.
3. Legal Basis for such data processing is the performance of the contract between you and Us Art. 6 (1) lit. b) of the GDPR. The provision of personal data is voluntary. However, the non-provision of personal data will result in you not being able to participate in the competition and claim the prize.
4. Data Transfer: The data will only be transferred on to third parties (e.g. shipping service providers) if this is necessary for the handling of the Sweepstake.
5. Data Retention: The data will be deleted as soon as the sweepstake has been completed. Under no circumstances will the data be stored for more than one year, unless we are required or permitted to retain the data for a longer period (e.g., for tax reasons).
6. Your Rights: As data subject, you have various rights in connection with the processing of your personal data. Under the conditions set out under applicable law (i.e., the GDPR), you have the following rights:
a. Right of access: You have the right to obtain from Us confirmation as to whether or not personal data concerning you is being processed, and, where that is the case, to request access to the personal data. The access information includes – inter alia – the purposes of the processing, the categories of personal data concerned, and the recipients or categories of recipients to whom the personal data have been or will be disclosed.
b. You have the right to obtain a copy of the personal data undergoing processing. For additional copies requested by you, we may charge a reasonable fee based on administrative costs.
c. Right to rectification: You have the right to obtain from Us the rectification of inaccurate personal data concerning you. Depending on the purposes of the processing, you have the right to have incomplete personal data completed, including by means of providing a supplementary statement.
d. Right to erasure (right to be forgotten): You have the right to ask Us to erase your personal data.
e. Right to restriction of processing: You have the right to request the restriction of processing your personal data. In this case,
the respective data will be marked and may only be processed by Us for certain purposes.
f. Right to data portability: You have the right to receive the personal data concerning you which you have provided to Us in a structured, commonly used and machine-readable format and you have the right to transmit those personal data to another entity without hindrance from us.
g. Right to object: You have the right to object, on grounds relating to your particular situation, at any time to the processing of your personal data by us and we can be required to no longer process your personal data. If you have a right to object and you exercise this right, your personal data will no longer be processed for such purposes by us. Exercising this right will not incur any costs. Such a right to object may not exist, in particular, if the processing of your personal data is necessary to take steps prior to entering into a contract or to perform a contract already concluded.
Please note that the aforementioned rights might be limited under the applicable national data protection law.
In case of complaints, you also have the right to lodge a complaint with the competent supervisory authority, in particular in the Member State of your habitual residence or alleged infringement of the GDPR.
